Hi everyone!  I need some advice. I posted a copy of the French erotic classic film "The Beast" which if you are not familiar with it deals explicitly with the issue of beastiality and although considered a classic is extremely sexually graphic.  I'm not prudish but it's pretty much hardcore porn in my opinion although it's not considered or classified as pornography (I certainly didn't know what I was getting myself into when I bought it lol).  Anyway, my issue is this:  I sent the person requesting the movie a PM forewarning them about the graphic content just in case they didn't know and I asked them to reply and just reassure me that they were over 18 years old.  This was a couple of days ago so I sent them another PM today saying I will mail their DVD as soon as they reply to my previous message which they still have not done.  Should I go ahead and send the DVD?  If they receive it and it happens to fall into the hands of a minor or if it's something they were not expecting can I get in trouble?  What are some of your thoughts?

I would not mail without receiving a PM back from them just because I'd want to make sure they were still active on the site.  I'm not sure of the site policy re: porn.

Well, the movie is not classified or considered 'porn' (I'd personally beg to differ lol).  It's put out by Argus Films which distributes classic foreign films. 

But yeah, if I don't hear back from them by Monday I think I'm just going to trash the thing.  I bought it without knowing what it was at the local used DVD store and thankfully I only payed $3 for it.

The person who ordered it had to have it wishlisted so they are either familiar with the film's contents or know that it is worth money because it is rare.  Personally, I would send it but with delivery confirmation insuring the credit (actually, I'd probably sell it on Ebay or Amazon for the $20+ that it's going for right now).  If it's in the system, then it's swapable.  I received a mockumentary from here called "Zoo" which deals with similar issues although it was primarily the language that was graphic.  By signing up for the site, the person has already affirmed that they are *supposed* to be 18, you really can't be held responsible or liable for if anyone under that age received this.

well, for one you are not allowed to have an account on swapadvd unless you are 18. Of course, people go online and make accounts and say they are 18 all the time elsewhere, but theres really nothing you can do. The best would be to assume they are following the rules and are over 18.

Like shellie said, however, I would not send it because the person is being non responsive to your pms. Let it time out and wait for them to respond, if they ever do, and then repost it to them.

If the upc is coming up and it's showing swapable then the dvd is ok for this site. As for PM responses, members are allowed to take up to like 5 or 7 days (sorry I can't remember exactly) to respond without a problem. Though I prefer to respond right away, other members are only on during certain times of week and cannot always respond with in a couple of days. If the member is still active and it was auto requested, I would personally proceed as the member verified their age when they signed up. And definitely use DC.

thats why i suggested to let it time out if they dont respond, that time limit is 5 days, so i would give the member the full 5 days to respond to you.

there are porn listings on Swap that somehow made it through the database change. These should not be allowed because they are porn, however, it could be misleading since they are in the system.  (Pornography is not allowed on Swapadvd per the rules.)

Pornography is not permitted on our site. As stated in the Terms of Use, when you sign up for our site:

"You agree not to post or ship any items of a sexually explicit, pornographic, or obscene nature. X-rated material is specifically prohibited."

We have filters in place to prevent pornographic listings from appearing on our site, but occassionally, some make through our filters. That does not make those items postable! If you see listings for pornography in our system, PLEASE contact feedback to have them removed. We try very hard to keep this material out of the system, but unfortunately, our filters cannot block every instance.

Kristen, "The Beast" is not considered pornography and is okay to trade on the site. It is also okay to assume that the requestor is 18 since all members are required to confirm that they are at least 18 years old when they register.

When I had a problem transaction last summer that I had to report to feedback, the response I was given was to allow member a week to respond to my PM and if they didn't to report it. Sorry for the confusion, wasn't referring to the acceptance timeframe.
